1. Acceptance of Terms

By accessing or using SYNC'D ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. SYNC'D is operated by SYNC'D Collective LLC ("we," "us," or "our").

2. User Accounts

By creating an account, you agree that:

• You are at least 18 years of age or have parental consent
• You will provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts at our sole discretion
• Account deletion is not guaranteed and is at the sole discretion of SYNC'D Collective LLC

3. User Content and License

When you post content on SYNC'D (including but not limited to photos, reviews, ratings, comments, or profile information), you grant SYNC'D Collective LLC:

• A worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content
• The right to use your content in any media format and through any media channels, including but not limited to social media platforms (Instagram, TikTok, Facebook, Twitter, etc.)
• The right to use your name, username, and likeness in connection with such content
• Permission to post user-generated content on our social media accounts and marketing materials without additional compensation or notification

You represent and warrant that you own or have the necessary rights to grant this license and that your content does not violate any third-party rights.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to the App or its systems
• Use the App for any commercial purpose without our written consent

5. Intellectual Property

All content, features, and functionality of SYNC'D, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of SYNC'D Collective LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Content Moderation and Removal

We reserve the right to:

• Monitor, review, and moderate all user content
• Remove any content at our sole discretion without notice
• Suspend or terminate user accounts for violations of these terms
• Refuse service to anyone at any time

7. Disclaimer of Warranties

SYNC'D is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, SYNC'D Collective LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new terms on this page. Your continued use of the App after such modifications constitutes your acceptance of the updated terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Important Notices

Social Media Content Usage

By using SYNC'D, you expressly grant us permission to use any content you post (including photos, videos, reviews, and comments) on our social media accounts (Instagram, TikTok, Facebook, Twitter, and any other platforms) without additional notification or compensation.

Account Deletion Policy

Account deletion is not automatic and is subject to review. We reserve the right to deny account deletion requests and to retain user data as necessary for legal, operational, or business purposes. Deletion requests may be submitted to minali@getsyncd.co but approval is not guaranteed.

Content Ownership

While you retain ownership of your original content, by posting on SYNC'D, you grant us a perpetual, irrevocable license to use that content as described in our Terms of Service.
